Workers Compensation Claims

Employees injured at work either physically or psychologically are entitled to receive benefits under NSW workers compensation legislation. They are:

 

  1. Weekly payments calculated on your pre-injury earnings.

  2. Reasonable and necessary medical treatment and rehabilitation costs

  3. Costs of re-training if you are unable to return to your pre-injury role

  4. Lump sum compensation for permanent impairment if your injuries reach a particular threshold or severity


In NSW the Independent Review Office, a government body will fund your claim for legal costs and disbursements meaning there is no cost to you for our services in bringing a claim on your behalf.


If you are injured at work and require time off or treatment you should lodge a workers compensation claim form and a medical certificate from your GP as soon as possible with your employer.


Workers compensation claims can become complex due to the circumstances of injury and the way insurers defend claims so it is advisable to obtain legal advice as soon as possible after your injury.

Firefighters Workers Compensation Claims

Firefighters injured on duty now have more generous entitlements. The thresholds are lower for workers compensation lump sum compensation and firefighters suffering from cancer are no longer required to prove causation due to presumptive legislation enacted in 2018. 

 

This means that if you are diagnosed with a cancer on the presumptive list of cancers after 27 September 2018 and you meet the qualifying service period you will be eligible to make a lump sum claim for compensation without the usual resistance engaged in by insurers.

Work Injury Damages Claims

If you are injured at work, physically or psychologically as a result of your employer’s negligence you may have a claim for damages if your injury is at least 15 % whole person impairment as agreed upon by the parties to the claim or an approved medical specialist  (AMS) if the parties cannot agree.


A work injury damages claim allows you to recover your lost earnings due to injury from the date of injury until the age of retirement. Depending on your age this can be a significant amount of compensation. These damages are received on top of workers compensation entitlements referred to above.


Work injury damages claims require an extensive investigation of the circumstances of injury,  expert opinion on liability and medical expert evidence. This can be costly; however we will pay these costs and recover them from the compensation that we obtain for you. We will act for you on a no win no fee basis.

Total and Permanent Disability Claims

Not many injured workers realise that that their superannuation policies offer compensation if they are unable to work. Apart from your super contributions you may be eligible for a significant lump sum payment under your policy if you are unable to return to your usual employment due to injury or illness. 

 

The amount claimable depends on the length of time and super contributions during your working life. Insurers can be difficult on these claims, always trying to delay claims for less than good reasons so if you haven’t returned to work due to injury or illness for at least 6 months you should contact us for advice on making a claim. Public Liability Claims

If you are injured in a public space such as a shopping centre, public building or job site, due to the negligence of the person or entity responsible for maintaining the safety of that space , then you may be eligible to claim compensation.
The key components of a public liability claim are:


Negligence

  •  To succeed in a public liability claim, the injured person must show that the person or entity responsible for the public space was negligent.  


Duty of Care

  • The person or entity that has care and control over the public space owe a duty of care that extends to taking reasonable steps to prevent injury or loss.


Injury, loss and damages

  •  The injured person must demonstrate that they have suffered injury or loss as a result of this negligence in order to recover damages.

  1. Medical and rehabilitation expenses

  2. Past and future economic loss

  3. Pain and suffering


Public liability claims require extensive investigation , expert and medical evidence. Motor Vehicle Accident Compensation Claims

If you have been injured in a motor vehicle accident you may be eligible for weekly payments, medical expenses and damages for pain and suffering depending on the degree of injury.


People that have suffered more serious injuries may be eligible for damages at common law in addition to the statutory benefits paid immediately after injury.

Medical Negligence Claims

Medical practitioners have a duty of care to their patients. A breach of that duty of care can occur in a variety of circumstances from a failure to warn a patient of the dangers involved in surgery, to a failure to correctly investigate or diagnose an illness.


Medical negligence can occur in a wide range of circumstances, however, the main ingredient is that there was a failure by the health professional or healthcare facility to exercise a reasonable degree of skill or care. If it is found that a medical professional has failed to provide this, and you have suffered loss and damage as a result of this failure, then you may be entitled to damages for that loss.
